Terms of Sale: Full payment, including shipping and handling is required with order. No work will proceed until payment is received. No refunds once your order has been processed. No partial refunds for work not completed.

Files: The customer is 100% responsible for the digital files supplied. If your file is not submitted properly, PRINT 5K will not be held responsible. We will not double check our files.

Customer Content: You understand that all information, data, text, photographs, graphics, messages or other materials ("Content") are the sole responsibility of the person from which such Content originated. This means that you, and not PRINT 5K, are entirely responsible for all Content that you use from PRINT 5K gallery or send, upload, post or transmit via the Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to not use the Service to send, upload, post or otherwise transmit any Content that contains (i) child pornography or anything indecent, obscene, lewd, lascivious, filthy or vile; (ii) a threat to kidnap or injure a person, a threat to injure the personal property or reputation of another person, a threat to accuse any person of a crime, a threat to inform another that a person has violated any law of the United States, or a threat of blackmail; (iii) any matter advocating or urging treason, insurrection, or forcible resistance to any law of the United States; (iv) any defamatory remarks directed at any other person or company; or (v) any content that infringes the intellectual property rights or other proprietary rights of PRINT 5K or any third party. PRINT 5K does not control the Content posted by Customers and does not guarantee the accuracy, integrity or quality of the Content. Under no circumstances will PRINT 5K be liable to you in any way for any Content you may be exposed to that you may find offensive, indecent or objectionable. Products and services, are provided for your personal use only. You agree to abide by these terms of service and not to use these products and services or related messages for any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.

You acknowledge that PRINT 5K does not pre-screen Content, but that PRINT 5K and its affiliates shall have the right (but not the obligation) in their sole discretion to remove any Content that violates the terms of service or may otherwise be objectionable. You further acknowledge and agree that PRINT 5K may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the terms of service; (c) respond to claims that the Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of PRINT 5K, its users and the public.

Governing Law: PRINT 5K is based in Fountain Valley, California and all transactions take place on PRINT 5K's servers located in Fountain Valley, CA. Any legal action or proceeding relating to or arising from your access to or use of this Site shall be instituted in Fountain Valley, CA. You agree to submit to the jurisdiction of Fountain Valley, CA courts and agree that venue in these courts is proper in any such legal action or proceeding.

Color Proofs: A color “Hard Copy” proof is required on all orders where the artwork is provided by the client and/or the order is color critical. Because of differences in equipment, processing, proofing, paper, inks and other conditions between color proofing and production pressroom operations, a reasonable variation in color between color proofs and completed job shall constitute acceptable delivery. If client does not have a proof, a color match proof may be purchased from PRINT 5K.

Color Accuracy: PRINT 5K will reproduce color from submitted images, transparencies, slides, photos, or digital layouts as closely as possible, but cannot exactly match color and density (as viewed in a 5000K light booth) because of limitations in the printing process, as well as neighboring image ink requirements. The accuracy of each color reproduction is to be within
85-90% of the original image you submitted. We accept no responsibility for color variations between submitted images and the actual
artwork or product they represent.

Mistakes: PRINT 5K is not liable for misspelled words. Clients must proof their jobs in full and are completely liable for any mistakes whether designed by PRINT 5K or not.

Indemnification: The customer will indemnify and hold harmless PRINT 5K , from any and all incidental losses, costs, expenses, and damages on any and all manner of claims, demands, actions and proceedings that may be instituted against PRINT 5K on the grounds alleging that said printing violates any copyright or any propriety right of any person, business or corporation.

Turnaround: Most jobs submitted by 10AM PST (Pacific Standard Time) that meet our digital file guidelines and include full payment will be printed within the lead time depending on the type of work. Business days are Monday to Friday and do not include weekends or holidays. Orders submitted on Saturday, Sunday, or holidays will begin on the next business day. PRINT 5K is not responsible for delays caused by delivery carriers or any damages resulting from the failure to receive a job on time. Orders may not be ready on time due to unforeseen circumstances such as breakdown of equipment, power outages, etc. Therefore, turnaround times are not guaranteed.

Changing files: As a courtesy to our customers, PRINT 5K allows replacement of files sent to the press but not yet printed depending on the job status. We will also make small adjustments to bleeds, sizes and color if files do not meet our guidelines.

Complaints: All complaints must be registered within 24 hours of receipt of job. Should the job contain manufacturing errors, we will rerun at no charge. We maintain the right to judge what a manufacturing error is.

Over and Under Run: Not to exceed 10% on quantities ordered, or the percentage agreed on, PRINT 5K will bill for actual quantity delivered within this tolerance. If customer required guaranteed exact quantities, client must let their Account Executive know when order is placed.

Sales Tax: All California orders are subject to sales tax. If customer is tax exempt, exemption certificate must be sent or faxed to us with the first order.

Materials and Samples: All materials we create in producing your job are the property of PRINT 5K. These materials will not be sold or given to any other party. We reserve the right to distribute free samples of your work and use it in our advertising.

We reserve the right to refuse service without disclosing a reason.
